The European Union Intellectual Property Office (EUIPO) has ruled against X-Technology Swiss of Zurich, revoking its trademark for the H-Dry brand name and related rights retroactively to the start of the legal dispute in December 2018. In reaction, Matteo Morlacchi – chief executive of the plaintiff, Luxembourg srl, and of the Italian firm Altexa srl, which handles operations for the similarly named HDry brand – noted that “the HDry portfolio of brands and patents is critical to the protection and advancement” of his company’s technology. Morlacchi and his brother Luca, who invented OutDry and then sold it to Columbia Sportswear, launched their new waterproof/breathable technology, HDry, at the last Ispo Munich show. X-Technology Swiss – which owns and licenses the X-Bionic and X-Socks brands, argued that its H-Dry brand was used from 2013 to 2016 for sports socks and underwear produced by its licensee Intersocks Group for Jack Wolfskin, Vans, Fila, Asics, Peak Performance, Intersport and Runners Point, but the plaintiffs noted that some of the products landed at some of the stores of low-priced retailers like Aldi and Lidl. EUIPO’s Cancellation Division, however, found that the company had provided insufficient evidence of the H-Dry trademark’s use in any of the products for which it was registered. X-Technology will have to pay the legal fees, and it will not be filing an appeal.
